END USER LICENSE AGREEMENT (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (“Licensee”, “User”, “Buyer”) and Terraquatic Tales (“Licensor”, “We”, “Us”) governing the use of licensed digital content purchased or downloaded from www.terraquatictales.com

By downloading, accessing, or using any content from this website, you agree to be bound by this Agreement.

1. Definitions

  • “Content” means any image, video, audio, graphic, or digital file available on this website.

  • “License” means the limited permission granted to use the Content.

  • “Commercial Use” means use for advertising, marketing, branding, monetized media, or business purposes.

  • “Editorial Use” means use for news, education, or documentary purposes only.

2. Ownership & Copyright

All Content is protected by copyright and other intellectual property laws.

  • Licensor retains full ownership and copyright of all Content.

  • This Agreement does not transfer ownership.

  • You are purchasing a license to use, not the Content itself.

3. License Grant

Upon full payment, Licensor grants you a non-exclusive, non-transferable, non-sublicensable license to use the Content according to the license type purchased.

Permitted uses depend on the license selected at checkout.

4. License Types (Example)

4.1 Personal License

  • Personal, non-commercial use only

  • No monetization

  • No redistribution

4.2 Commercial License

  • Commercial and promotional use allowed

  • Digital and print media

  • No resale or redistribution as standalone files

4.3 Extended Commercial License

  • Large-scale commercial use

  • Broadcast, advertising, paid products

  • Still no resale as standalone content

4.4 Editorial License

  • News, education, documentary use only

  • No commercial, advertising, or promotional use

5. Prohibited Uses (Strictly Not Allowed)

You may NOT:

  • Resell, redistribute, or share Content as standalone files

  • Claim authorship or copyright ownership

  • Use Content in illegal, defamatory, hateful, pornographic, or misleading material

  • Use Content to imply endorsement by any person depicted

  • Use Content in logos, trademarks, NFTs, AI training datasets, or resale templates unless explicitly permitted

  • Remove copyright metadata or watermarks

6. Modifications

  • You may resize, crop, or color-correct Content unless restricted by license

  • Modifications do not grant ownership

  • Modified Content remains subject to this Agreement

7. Model & Property Releases

  • Licensor confirms releases only where explicitly stated

  • If Content is marked “Editorial Only”, no releases are provided

  • Licensee is responsible for determining suitability for their use

8. Attribution

  • Attribution is not required unless stated otherwise

  • If required, credit must appear as:

9. Term & Termination

  • This license is valid indefinitely unless terminated

  • License terminates automatically if you breach any terms

  • Upon termination, all use of Content must stop immediately

10. Refund Policy

  • Due to the digital nature of Content, all sales are final and non-refundable.

11. Disclaimer of Warranties

Content is provided “as-is”.

Licensor makes no warranties regarding:

  • Accuracy

  • Fitness for a particular purpose

  • Legal compliance of buyer’s usage

12. Limitation of Liability

To the maximum extent permitted by law:

  • Licensor shall not be liable for indirect or consequential damages

  • Maximum liability is limited to the amount paid for the license

13. Indemnification

You agree to indemnify and hold Licensor harmless from any claims arising from:

  • Misuse of Content

  • Violation of this Agreement

  • Use beyond licensed permissions

14. Governing Law & Jurisdiction

This Agreement shall be governed by the laws of India.
All disputes shall be subject to the exclusive jurisdiction of courts in India.

15. Changes to This Agreement

Licensor reserves the right to modify this Agreement at any time.
Continued use of Content constitutes acceptance of updated terms.
